These Terms of Service govern your use of loftyden.com and any purchase you make from it. By using this site or placing an order you agree to these terms. Please read them.

1. Who we are

This site is operated by Lofty Den, 30 North Gould Street, Ste N 3012, Sheridan, WY 82801, United States. In these terms, "we", "us" and "our" mean Lofty Den, and "you" means the person using the site or placing an order.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order.

3. Products, descriptions and images

We work hard to describe our products accurately. Specifications such as dimensions and weight capacities are supplied by the manufacturer. Colours can appear differently between screens, and measurements may vary slightly between production runs. A product image is an illustration, not a guarantee of exact appearance.

4. Pricing and availability

All prices are in US dollars and may change without notice. Availability is not guaranteed until your order is accepted. If an item becomes unavailable after you order, we will contact you and refund you in full.

We reserve the right to correct pricing or description errors, and to cancel any order placed at an incorrect price, even after the order has been confirmed. If we cancel for this reason, you receive a full refund.

5. Orders

Your order is an offer to buy. We may refuse or cancel an order for any lawful reason, including suspected fraud, a reseller-scale quantity, or an address we cannot ship to. An order confirmation email is an acknowledgement of receipt, not acceptance.

6. Payment

Payment is taken at checkout through our payment processor. We do not store your full card details. You confirm that you are authorised to use the payment method you provide.

7. Shipping and returns

Shipping is governed by our Shipping Policy and returns by our Return & Refund Policy. Both form part of these terms.

8. Product safety and correct use

Our products are pet accessories, not medical or veterinary devices, and nothing on this site is veterinary advice. Please:

Observe the stated weight capacity for your pet and never exceed it
Follow the assembly and use instructions supplied with the product
Supervise your pet when using any carrier, stroller, restraint or elevated product
Inspect straps, frames, zips and fastenings regularly and stop using a product that is worn or damaged
Consult your veterinarian before using a mobility product with a pet that is injured, elderly or recovering

You are responsible for choosing a product suitable for your pet and for using it safely.

9. Intellectual property

The Lofty Den name, our site design, and our original text and images belong to us and may not be copied or used commercially without written permission.

10. Acceptable use

You agree not to use this site unlawfully, to attempt to gain unauthorised access to it, to interfere with its operation, to scrape it at a scale that degrades service, or to submit false information.

11. Reviews and submissions

If you submit a review or other content, you grant us a non-exclusive, royalty-free licence to use and display it in connection with our business. We may remove content that is unlawful, abusive or misleading.

12. Disclaimers

The site and our products are provided "as is" and "as available", except where a warranty cannot lawfully be excluded. We do not warrant that the site will be uninterrupted or error free.

13. Limitation of liability

To the fullest extent permitted by law, our total liability arising out of any order is limited to the amount you paid for that order. We are not liable for indirect, incidental or consequential losses. Nothing in these terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by our negligence, or for fraud.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

14. Indemnity

You agree to indemnify us against claims arising from your breach of these terms or your misuse of a product.

15. Third-party links

Our site may link to third-party sites. We do not control them and are not responsible for their content or practices.

16. Privacy

Your personal information is handled in accordance with our Privacy Policy.

17. Governing law

These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law rules. Any dispute will be brought in the courts located in Wyoming, unless the law where you live requires otherwise.

18. Changes

We may update these terms at any time. The version in force is the one published on this page when you place your order. Continuing to use the site after a change means you accept the updated terms.
