These Terms of Service govern your use of loftyden.com and any purchase you make from it. The store is owned and operated by 1ClickStart Ventures LLC, a limited liability company organized in the United States. In these terms, "Lofty Den", "we", "us", and "our" mean 1ClickStart Ventures LLC. "You" means the person using the site or placing an order.

Accepting These Terms

By browsing this site, creating an account, or placing an order, you agree to these terms. If you do not agree with them, do not use the site.

Our Privacy Policy, Refund Policy, and Shipping Policy are part of these terms and apply to you in the same way. Where our Privacy Policy and these terms conflict on anything to do with your personal information, the Privacy Policy wins.

Who Can Use This Site

You must be at least 18 years old, or the age of majority where you live, to place an order. If you are under that age you may only use the site with the involvement of a parent or guardian, and they are responsible for the order.

By placing an order you confirm that you are using a payment method you are authorized to use, and that the information you give us is accurate and complete.

We sell to customers in the United States only. See our Shipping Policy for where we deliver.

Products, Descriptions, and Images

We try hard to describe our products accurately, including dimensions, weight ratings, materials, and colors. Even so, product photography and your screen will not match a physical item perfectly, and colors in particular can look different in person.

Product descriptions, images, dimensions, and specifications are provided for guidance. They are not a warranty that a product will be a specific shade, or that it will suit a specific pet. Where a weight rating or size is critical to you, check the stated dimensions and weight limits before you buy, and ask us if anything is unclear.

We can change or discontinue any product at any time without notice. We can also limit the quantity of any product you buy, and limit or refuse sales to any customer, region, or reseller.

Pricing and Errors

All prices are in US dollars and do not include sales tax or shipping, which are calculated at checkout. Prices can change at any time before you place an order.

We do our best to keep prices, product details, availability, and promotional terms accurate on the site. Errors still happen. If a product is listed at the wrong price, described incorrectly, or shown as available when it is not, we reserve the right to correct the error and to cancel or refuse any order placed at the incorrect price, even after the order is confirmed and payment is taken.

If we cancel an order for this reason, we will tell you and refund you in full. We are not obliged to sell you an item at an incorrect price.

Orders, Acceptance, and Cancellation

Your order is an offer to buy. Our order confirmation email confirms we received it, and it is not our acceptance of it. The contract between us forms only when we ship the order.

We can refuse or cancel any order, in whole or in part, for any lawful reason, including:

The product is out of stock or no longer available.
The price or description was incorrect.
Payment was declined, reversed, or looks fraudulent.
The billing and shipping details do not check out.
The order appears to be for resale.
We cannot ship to the address you gave us.

If we cancel an order you have already paid for, we refund it in full to your original payment method. You can ask us to cancel your own order at any time before it is handed to the carrier. See our Refund Policy for what happens after that.

Payment

Payment is taken at checkout through Shopify and its payment providers. We do not store your full card details. You authorize us to charge the payment method you provide for the full order amount, including tax and shipping.

Shipping, Returns, and Refunds

Delivery timescales, rates, and lost parcel handling are set out in our Shipping Policy. Returns, the 30-day window, and refunds are set out in our Refund Policy. Both apply to every order.

Accounts

If you create an account, you are responsible for keeping your password secure and for everything that happens under your account. Tell us straight away if you think someone else has access to it. We can suspend or close an account that is being misused.

Intellectual Property

Everything on this site belongs to us or to our licensors. That includes the Lofty Den name and logo, the site design, text, product descriptions, photography, video, graphics, and the arrangement of all of it. It is protected by copyright, trademark, and other laws.

You may view the site and share links to it. You may not copy, reproduce, republish, sell, or use our content commercially, scrape the site, or use our name, logo, or images in a way that suggests we endorse you, without our written permission.

Acceptable Use

You agree not to:

Use the site for any unlawful purpose, or to break any law in your jurisdiction.
Submit false information, impersonate anyone, or use someone else's payment method.
Upload viruses, malicious code, or anything designed to interfere with the site.
Probe, scan, overload, or attempt to gain unauthorized access to the site or its systems.
Use bots, scrapers, or automated tools to harvest content, prices, or customer information.
Harass, abuse, or threaten our staff, other customers, or anyone else.
Interfere with the security features of the site.

We can suspend your access or cancel your orders if you do any of this.

Reviews and Anything Else You Submit

If you send us a review, photo, comment, or suggestion, you give us a free, non-exclusive, worldwide, perpetual right to use, publish, and adapt it for any purpose, including marketing, without paying you or crediting you. You confirm the content is yours to give, that it is accurate, and that it does not break anyone else's rights or any law.

We are not obliged to publish anything you send, and we can edit or remove it.

Product Use and Pet Safety

Our products are pet accessories and pet furniture. They are not medical, veterinary, or safety devices.

You are responsible for choosing a product that is right for your animal, for assembling it according to the instructions supplied, for placing it safely, and for supervising your pet's use of it. Do not exceed a stated weight limit. Check products regularly for wear, loose fixings, and damage, and stop using anything that is damaged.

Nothing we publish is veterinary advice. Talk to your veterinarian about your animal's health, mobility, or behavior.

Third Party Links and Services

The site may link to third party websites, and it relies on third party services such as Shopify, payment processors, and shipping carriers. We do not control those parties and we are not responsible for their content, products, or actions. Your dealings with them are between you and them.

Disclaimers

We provide the site and the products on it on an "as is" and "as available" basis. To the fullest extent the law allows, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not promise that the site will be uninterrupted, secure, error free, or free of harmful components, or that any content on it is accurate, complete, or current.

Some states do not allow the exclusion of certain warranties. Where that applies to you, the exclusions above apply only to the extent your state permits, and this does not affect any right you have under applicable consumer protection law.

Limitation of Liability

To the fullest extent the law allows, 1ClickStart Ventures LLC and its managers, members, employees, and agents are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages. That includes lost profits, lost data, loss of goodwill, injury to a pet, or damage to property, whether the claim is in contract, tort, strict liability, or anything else, and whether or not we were told such damages were possible.

Where we are found liable despite the above, our total liability to you for any claim relating to an order or to your use of the site is limited to the amount you actually paid us for the order that gave rise to the claim.

Some states do not allow these limitations. Where that applies to you, our liability is limited to the smallest amount your state permits.

Indemnification

You agree to defend, indemnify, and hold harmless 1ClickStart Ventures LLC and its managers, members, employees, and agents from any claim, demand, loss, liability, or expense, including reasonable legal fees, arising out of your breach of these terms, your misuse of the site, your violation of any law, or your violation of anyone else's rights.

Governing Law

These terms and any dispute arising from them or from your use of the site are governed by the laws of the State of Wyoming, without regard to its conflict of law rules. You and we agree that any legal action must be brought in the state or federal courts located in the State of Wyoming, and you consent to the personal jurisdiction of those courts.

Nothing here removes any right you have to bring a claim in your own state where the law gives you that right, and nothing here waives any non-waivable consumer protection right.

Severability and Entire Agreement

If any part of these terms is found unenforceable, that part is limited or removed to the minimum extent needed, and the rest stays in force. If we do not enforce a right under these terms, that is not a waiver of it.

These terms, together with our Privacy Policy, Refund Policy, and Shipping Policy, are the entire agreement between you and us about the site and your orders, and they replace any earlier agreement or understanding.

Changes to These Terms

We can update these terms at any time. The current version is always on this page, with the "Last updated" date at the top. Changes take effect as soon as they are posted. Your order is governed by the version of these terms in force when you placed it. Continuing to use the site after a change means you accept the updated terms.
